We updated our company contact details (registered name, address, and a new support email at contact@infiworks.co.in) and clarified, in plain language, how your data is handled and protected. We also set out how mess owners sign in (§2, §3), that CloudMess is a paid service for mess owners after a free trial (§4.2), that paying for it on time is an owner’s responsibility (§5), and how to close your account (§9). For members, the service and your responsibilities are unchanged. Our liability limits are unchanged.
These Terms of Service (“Terms”) govern your use of the CloudMess Owner App and Customer App (“the Apps”) operated by InfiWorks Technologies Private Limited, a company incorporated in India (“we”, “us”, “our”). By creating an account you agree to these Terms.
If you do not agree, please do not use the Apps. You can stop using them at any time.
The service
1. The service
CloudMess is a software service that helps Indian mess owners run a monthly-subscription meal business and helps members of those messes manage their attendance, payments, and meal preferences. It connects:
- Owner App — a tool for mess owners to set up their mess, configure plans, manage members, run a daily intent survey, dispatch tiffins, and record payments.
- Customer App — a tool for mess members to scan QR codes for meal attendance, respond to the daily survey, view their dues, and pay via UPI.
CloudMess is the software platform only. We do not cook, serve, or deliver food. The mess owner is responsible for the actual meals. We are not a party to your subscription contract with your mess — that is a separate agreement between you and the owner.
Eligibility
2. Who can use it
- You must be at least 18 years old. CloudMess is not intended for minors, and a parent or guardian using the app “on your behalf” does not change that — the data in the account would still be a child’s. If you are under 18, ask your mess owner to handle your membership without an app account. See Privacy Policy §7.
- You must be a resident of India.
- Members sign in with a valid Indian mobile number (+91). Mess owners sign in with an email address and password that we issue when we create your account.
- Owners must be operating a legitimate mess business in India and comply with all applicable food safety, tax, and labour laws.
We may suspend or terminate accounts that we reasonably believe violate these rules. We will tell you before doing so unless we suspect fraud or an immediate safety risk.
Accounts
3. Your account
- Members sign in with a phone number and a one-time code. You are responsible for keeping your phone and SIM secure.
- Mess owners sign in with an email address and a password. You are responsible for keeping that password secret, for not using it anywhere else, and for telling us at once if you believe someone else has it.
- Tell us immediately if you suspect your account has been accessed without permission.
- Do not share your account, transfer it to another person, or attempt to impersonate someone else.
- The data you enter (your name, plan details, etc.) must be accurate.
Payments
4. Payments
4.1 Member payments to the mess
Members pay their mess directly. The owner records cash and UPI payments inside the Owner App; members can start a UPI transfer using a deep-link the Customer App composes for them.
- CloudMess does not process money between members and messes. Your UPI payment goes directly from your bank to the mess owner’s UPI account via your UPI app.
- We do not charge members a transaction fee.
- The owner is responsible for verifying that the payment landed. Disputes are between you and the owner; we provide audit logs and receipts to help resolve them but we are not a financial arbitrator.
4.2 Subscription (CloudMess platform)
CloudMess is a paid service for mess owners, offered with a free trial. When you sign up as a mess owner you get a free trial; after it ends, continued use needs a paid subscription.
- We tell you the applicable plan and price before your free trial converts to a paid subscription, so you can decide whether to continue.
- Payment is made directly to INFIWORKS TECHNOLOGIES PRIVATE LIMITED by UPI, bank transfer, or cash. CloudMess does not currently use an in-app payment gateway and does not charge you through the app; if this changes we will tell you.
- Your billing frequency, cancellation, and refund terms are set out in your subscription confirmation at sign-up.
- If we change the price or terms for an existing subscriber, we give reasonable advance notice by email.
Responsibilities
5. Your responsibilities
Owners
- Run your mess in compliance with Indian food safety, tax, labour, and FSSAI regulations.
- Honour the subscription terms you offer your members (plan duration, meal count, holiday credits, etc.) — the app helps you track these but does not enforce them legally.
- Respond to member disputes in good faith.
- Pay any taxes you are liable for on the income you record through the app.
- Treat member data confidentially. Do not share member phone numbers or other personal data with third parties.
- Pay your CloudMess subscription on time, per the confirmation you received at sign-up.
Members (customers)
- Only scan the QR for meals you are eligible for. Scanning fraud is a breach of these Terms and of your subscription contract with the mess.
- Pay your dues on time per the plan you agreed to with the mess.
- Respond honestly to the daily intent survey — it helps the mess cook the right quantity and reduces food waste.
Acceptable use
6. Acceptable use
You may not:
- Reverse-engineer, decompile, or attempt to extract the source of the Apps beyond what Indian law explicitly allows.
- Probe, scan, or test the security of the platform without our written permission. Authorised security testing requires a separate agreement.
- Use the Apps to send unsolicited messages or harass other users.
- Attempt to access another user’s account or data.
- Use the Apps to commit fraud, including but not limited to scanning meals on someone else’s behalf without authorisation, or recording fictitious payments.
- Use the Apps for any unlawful purpose under Indian law.
Violations may result in account suspension and/or legal action.
Availability
7. Service availability
We try hard to keep CloudMess available, but we do not guarantee uptime. The service may be unavailable for:
- Planned maintenance (we will notify in advance where possible).
- Outages from our infrastructure providers.
- Force majeure events (natural disasters, internet outages, etc.).
The offline scan queue is designed to absorb short outages — your scans are saved on your phone and synced when connectivity returns. But we cannot guarantee that all features work offline.
Liability
8. Limits of our liability
To the maximum extent permitted by Indian law:
- We provide the Apps “as-is” and “as-available”.
- We are not liable for losses you suffer because the Apps were unavailable, lost data due to a third-party outage, or behaved in a way you did not expect.
- We are not liable for disputes between owners and customers about the underlying mess subscription — including meal quality, hygiene, delivery timing, or pricing.
- Our maximum total liability to you for any claim arising out of or related to the Apps is limited to ₹1,000 (one thousand Indian rupees), unless Indian law requires a higher amount.
Nothing in these Terms excludes liability that we cannot exclude under Indian law (such as liability for gross negligence, fraud, or wilful misconduct).
Termination
9. Termination
By you
You can stop using the Apps at any time. To close your account and delete your data, email us at the address in §12 — members should tell us the mobile number they sign in with, mess owners should write from the email address they sign in with. We act within 30 days. Privacy Policy §5 sets out what we must keep afterwards and for how long.
Closing a mess-owner account also closes the mess. Before we act, we will tell you exactly what will be kept and what your members will see.
Request account deletionBy us
We may suspend or terminate your account if you violate these Terms, abuse the platform, or use the Apps for fraud. We will give you a chance to respond before terminating unless we suspect immediate harm.
If your mess (as an owner) is terminated, your members can no longer use it in the app. Any of them can still email us at the address in §12 for a copy of their records, and we will respond within 30 days.
Changes
10. Changes to these Terms
We may update these Terms. When we do, we update the “Effective date” and “Last updated” fields at the top and summarise what changed in a note below them.
The current version is always readable inside the app under Settings → Terms of Service, and on the web at cloudmess.in/terms.
If you do not accept a change, you can stop using the Apps and ask us to delete your account.
Governing law
11. Governing law and disputes
- These Terms are governed by the laws of India.
- Disputes will be resolved exclusively by the courts of Beed, Maharashtra, where our registered office is located.
- If you are a consumer, this does not take away any right you have under the Consumer Protection Act, 2019 to bring a complaint where you live or work.
- We prefer to resolve disputes informally first. Please email us before escalating.
